GENERAL CONDITIONS OF SALE

1. This document (General Conditions of Sale) defines the conditions applicable to sales concluded at a distance through the website www.airportboutique.it between the company BEBE AIRPORT SRL SIMPLIFIED and the purchaser of the Products 1 Information on the Seller

2 General Provisions

2.1. The Customer is required to carefully read the General Conditions of Sale which

BEBE AIRPORT SRL SIMPLIFIED makes available to you on the Site, in order to allow you to know, memorize and reproduce it.

2.2. Each order requires full acceptance of these General Terms and Conditions of Sale. By sending the order, therefore, the Customer declares to have read the General Conditions of Sale available on the Site and to accept them in full.

2.3. These General Conditions of Sale are drawn up in Italian and are applicable only to Sales Contracts concluded through the Site by Customers who reside and indicate a delivery address in Italy or Europe.

2.4 The site can be accessed from all over the world but shipments can only be made in Italy and Europe

2.5. In order to make purchases through the Site, the Customer must be of legal age (18 years) and have the ability to act, which the Customer declares to possess.

2.6. Any costs for Internet connection to the Site, including telephone costs, according to the rates applied by the operator selected by the Customer are the exclusive responsibility of the Customer.

3 Products: information and availability

3.1. The presentation of the Products on the Site does not in any case constitute an offer to the public but only BEBE AIRPORT SRL SIMPLIFIED an invitation to the Customer to formulate a contractual purchase proposal, which BEBE AIRPORT SRL SIMPLIFIED reserves the right to accept or not.

3.2. The information relating to the Products is reported on the Site, for each Product, through textual and photographic contents.

3.3. The photographic content is for the sole purpose of presenting the Products for sale. Since the chromatic aspects may not represent the real Product with absolute fidelity, also due to the effect of the browser or monitor used by the Customer, for these aspects, absolute coincidence between the image on the Site and the real Product is not guaranteed.

3.4. The Products are sold with the characteristics presented on the Site at the time the Customer sends the order.

3.5. The availability or non-availability of the Products is indicated on the Site, for each Product. The sale of Products is subject to availability on the Site, and it will not be possible to proceed with the purchase of Products presented as not available on the Site. BEBE AIRPORT SRL SIMPLIFIED does not assume responsibility for having to search and find unavailable Products from other sources .

3.6. If, for any reason, the Products already ordered by the customer turn out to be unavailable for sale, BEBE AIRPORT SRL SIMPLIFIED will proceed to promptly notify the Customer and refund, in favor of the Customer, any sum already paid, and there will not be, for BEBE AIRPORT SRL SIMPLIFIED, the obligation to deliver the goods ordered.

3.7. If an ordered Product is listed at an incorrect price, due (for example) to an error by BEBE AIRPORT SRL SEMPLIFIED, the Customer will be informed of the error and will receive a refund of the price paid. In this situation the Product will not be shipped.

3.8. BEBE AIRPORT SRL SIMPLIFIED reserves the right to modify the information relating to each Product, the assortment of Products on the Site and their availability at any time and without notice.

4 Order

4.1. The order sent by the Customer has the value of a contractual proposal and implies knowledge and full and unreserved acceptance of the General Conditions of Sale in force at the time of the order.

4.2. BEBE AIRPORT SRL SIMPLIFIED reserves the right to modify these General Conditions of Sale at any time, at its sole discretion and without notice. Any changes made will be considered valid from the date of publication of the document on the Site and will only be applied to orders placed after that date.

4.3. In order to proceed with the purchase of the desired Products, present on the Site and available for sale, the Customer must insert the Products of interest in the virtual shopping cart. The Customer can subsequently choose to complete the purchase of the Products in the virtual shopping cart as a guest customer or register on the site with his own account.

4.4. At the time of the purchase, the Customer must provide his personal data required to complete the order and the sales contract.

4.5. In order to proceed with the purchase, the Customer must access the detail page of the product he intends to purchase, by clicking on the product image on the Product listing pages, or on a link that leads to the detail page of the product itself. If intending to purchase the product, the customer must select the desired size for the product and insert the product of interest in the virtual shopping cart, by clicking on the appropriate "ADD TO CART" button located on the product detail page.

4.6. After adding the product to the virtual cart, the Customer can proceed with the checkout or complete the purchase procedure. One item = one purchase.

4.7. If the Customer chooses to proceed with the checkout, he will reach a summary page of the contents of the virtual cart for which he is about to purchase. Here you will have the option to remove the item from your cart. The Customer can also view the total price of the item in the cart here, net of any costs due to shipping.

4.8. The checkout procedure is divided into the following stages:

• Entering personal information, with the ability to order as a guest.
• Entering shipping and billing addresses. The Customer must enter the data regarding the shipping and billing address here.
• Payment. The Customer can then choose the desired payment method, among those listed. The Customer can then proceed with the payment, finalizing the order, which will be forwarded to BEBE AIRPORT SRL SIMPLIFIED.
• (Will order confirmation email be sent? If yes, add) Once these steps have been completed, the Customer will be sent an order confirmation number which it is recommended to write down. If you have an account, your order details will appear in the appropriate section of that account.
• Additionally, an order confirmation email will be sent to confirm that your order is being processed. Once the order confirmation has been received, it will no longer be possible to make changes to the delivery address provided.

5 Price

5.1. The prices of the Products are expressed in Euros and are inclusive of all applicable taxes and/or duties (including VAT), excluding any shipping and handling costs, which will be highlighted on the order confirmation page, before of the definitive forwarding of the same by the Client to BEBE AIRPORT SRL SIMPLIFIED.

5.2. The Customer is required to pay BEBE AIRPORT SRL SIMPLIFIED the total amount shown on the order confirmation page. The total amount of the order must be paid in its entirety in a single solution, using the payment methods made available to the Customer by BEBE AIRPORT SRL SIMPLIFIED.

5.3. The sale price of the Products is the price in force at the time of the order on the Site.

5.4. BEBE AIRPORT SRL SIMPLIFIED reserves the right to change the prices of the Products and the handling and shipping costs at any time and without notice.

5.5. BEBE AIRPORT SRL SIMPLIFIED constantly checks that the prices shown on the Site are correct. However, due to technical problems not immediately detected, it may happen that the price shown for one or more items is clearly lower than the price normally applied, even net of any discounts and/or promotions in force.

5.6. If the Customer detects that the price of one or more of the Products available for purchase is clearly lower than that normally applied, even net of any discounts and/or promotions in force, he is requested not to complete the order procedure for the aforementioned Products and to promptly report the anomaly by sending an email to the email address info@airportboutique.it. If the Customer nonetheless completes the order procedure, AIRPORT SNC DI

MONICA ELENA BONAMIGO & C. reserves the right to cancel the order, proceeding to promptly notify the Customer and to refund, in favor of the same, any amount already paid. In this case there will be no obligation for BEBE AIRPORT SRL SIMPLIFIED to deliver the goods ordered.

6 Shipping and delivery

6.1. The expected delivery method is shipping by Express Courier and home delivery;

6.2. Standard national and European shipping (excluding Switzerland and the UK) via courier will be free.

6.3. The indicative and non-binding delivery times for the expected shipping method, barring unforeseen circumstances, are 2/4 working days throughout the national territory (for the smaller islands, two additional working days are foreseen). For international shipments, the indicative delivery times are 2/10 working days.

6.4. Working days are understood to be all those between Monday and Friday, inclusive, therefore with the exclusion of Saturday and Sunday and any midweek public holidays.

6.5. BEBE AIRPORT SRL SIMPLIFIED undertakes to do everything in its power in order to respect the delivery times indicated on the Site and, in any case, to carry out the delivery within a maximum time of 30 (thirty) days starting from the day following that in which the Customer sent the order.

7 Payment

7.1. The customer can choose between the following payment methods:

• Credit card (Visa, MasterCard and Maestro circuits)
• PayPal

7.2. In case of payment by credit card, the credit card data will be communicated directly to Shopify or Paypal which takes care of electronic payments on behalf of BEBE AIRPORT SRL SIMPLIFIED. The transmission of such data will take place through encrypted transmission protocols with the 128-byte SSL (SecureSocketLayer) system. These data will not be accessible to BEBE AIRPORT SRL SIMPLIFIED. The amount will be charged when the order is processed. To ensure the highest level of security and minimize the risk of access by third parties to the Customer's bank details, the Customer will be required to enter his credit card number for each new order, if this is the chosen payment system.

7.3. In case of payment by PayPal, the Customer will be transferred to the payment page set up by PayPal, where, using the credentials of his PayPal account, he will be able to complete the payment procedure. The transmission of the customer's credentials will take place through encrypted transmission protocols with the 128-bit SSL (SecuretSocketLayer) system directly on the page prepared by PayPal, and these data will not be accessible to BEBE AIRPORT SRL SIMPLIFIED. The amount will be charged when the order is processed.

7.4. In the event that it is not possible for BEBE AIRPORT SRL SIMPLIFIED to process the order due to unavailability of the selected Products, the order will be canceled and the order amount, if already paid, will be refunded to the Customer. In the event that the debit of the amounts due by the Customer is not possible, for any reason whatsoever, the purchase process will be canceled and the order cancelled.

7.5. The Customer agrees to receive the receipt relating to the purchase made exclusively in electronic format.

7.6. The Customer may request the issuance of the tax invoice exclusively during the order procedure, subsequently entering, where required, his VAT number and unique code or his Tax Code. It will not be possible to request the issuance of the invoice after completing the order.

8 Right of withdrawal and return procedure.

8.1 Without giving any reason, the Customer has the right to cancel an order or part of an order within fourteen (14) days (“cancellation period”). This cancellation period begins with the receipt of all products within the order and ends fourteen (14) days from that date.

8.2 The Order is considered received when the Products inside it come into the physical possession of the Customer or a third party indicated by the latter.

8.3 To effectively cancel the order or part of the order, you must clearly communicate your intention to cancel it to info@airportboutique.it

8.4 Before returning the goods, the Customer must wait for the receipt of the return authorization form, which will be sent to him by e-mail following receipt of the declaration of the will to exercise the right of withdrawal by the Customer, if communicated within the terms and in the manner described above.

8.5 Following this communication, the Product or Products must be returned to BEBE AIRPORT SRL SIMPLIFIED at the Customer's expense, without delay, and in any case no later than fourteen (14) days from the date on which the cancellation of the order was communicated, by inserting in the package the form referred to in art. 11 of these Conditions of Sale.

8.6 It is advisable to obtain proof of postage for such returns.

8.7 It will not be possible to exchange the purchased goods. In the event that the Customer wishes to exchange goods, he must return the purchased Product according to what is written in the previous paragraphs, and proceed with a new order.

The Products returned making use of the right of withdrawal must be new, in excellent condition, and must only have been tried on, therefore without signs of wear or dirt. The Products must be returned in the original packaging and equipped with all accessories, instructions for use and intact labels, together with the transport document present in the original packaging, taking care to remove or obscure any label or material pertaining to the previous shipment.

8.8 If the returned Products do not comply with the provisions or the terms and conditions for exercising the right of withdrawal are not respected, the withdrawal will not be effective. In this case the Customer will not be entitled to a refund of the sums already paid. The Customer will be able to get back, at his own expense, the Products in the state in which they were delivered to BEBE AIRPORT SRL SIMPLIFIED.

8.10 The non-acceptance of the returned Products will be notified to the Customer by email.

8.11 BEBE AIRPORT SRL SIMPLIFIED is not responsible for the refund relating to Products shipped but not received by BEBE AIRPORT SRL SIMPLIFIED due to loss, theft or damage or other causes in any case not attributable to BEBE AIRPORT SRL SIMPLIFIED.

9 Effects of withdrawal:

9.1 BEBE AIRPORT SRL SIMPLIFIED, in the event of cancellation of the entire order, will refund all payments received including, if made, those relating to delivery costs to the Customer who has correctly exercised the right of withdrawal. In the event of partial cancellation of an order, the price of the returned products will be refunded, in proportion to each returned item.

9.2 However, the extra cost resulting from choosing a particular delivery method other than standard delivery will not be refunded.

9.3 within 14 days of receipt of the Product and returned Products. If the cancellation takes place before the order has been shipped, the refund will be made within fourteen (14) days of receipt of the decision to cancel the order.

9.4 Unless otherwise agreed with the Customer, the refund is made using the same means of payment used for the initial transaction. The User does not have to bear any costs as a result of the withdrawal.

The return shipping costs are borne by BEBE AIRPORT SRL SIMPLIFIED

10 Exceptions to the right of withdrawal

There is no right of withdrawal from contracts:

• the supply of goods which are likely to deteriorate or expire rapidly;
• supply of sealed goods which are not suitable for being returned for hygienic or health protection reasons and which have been opened after delivery;

1. Documentation to be attached to the return

Pursuant to art. 54 of Legislative Decree 6 September 2005 n. 206, the model withdrawal form is shown below, which the Customer can use to inform BEBE AIRPORT SRL SIMPLIFIED regarding the desire to exercise the right of withdrawal, as an alternative to any other explicit declaration.

12 Incorrect, Defective, Damaged or Misdescribed Products and Refunds.

12.1 Products deemed non-compliant, because they are defective, damaged, unsuitable or not described correctly, can be returned to BEBE AIRPORT SRL SIMPLIFIED who will examine them. If the defect is recognized, BEBE AIRPORT SRL SIMPLIFIED will send the same product if still available; if not available, it will reimburse the price of the Product and any shipping costs paid by the Customer, to purchase and return the Product.

12.2 If the defective Product was sent with other unreturned Products, only the initial pro rata delivery costs will be refunded.

12.3 Refunds will be made within fourteen (14) days of acknowledgment of the defect, using the original payment method.

13 Legal guarantee of conformity

13.1 The provisions of the Consumer Code concerning the legal guarantee of conformity and commercial guarantees apply to the Products purchased through the Site.

13.2. The warranty only concerns the presence of non-conformity defects of the Product. No guarantee is applied in the event of damage to the Product deriving from the Customer's negligence or from use and/or washing of the Product that does not comply with that of the Product and/or with the indications provided by BEBE AIRPORT SRL SIMPLIFIED and/or indicated in the documentation attached to the Product, in tags, labels or in its packaging.

13.3. In order to make use of the guarantee, which has a legal duration of two years from the delivery of the goods, the Customer must report the lack of conformity to BEBE AIRPORT SRL SIMPLIFIED within and no later than two months from the discovery, by sending an email to info@airportboutique .it containing:

• Your personal data;
• The indication of the order number;
• The indication of the defect and/or non-conformity found;
• At least 1 photograph of the Product that highlights the non-compliance found.

13.4. If BEBE AIRPORT SRL SEMPLIFIATA decides to authorize the return of the Product, only for the cases of faulty goods or goods that do not conform to the one ordered, the return will be made by courier at the expense of BEBE AIRPORT SRL SEMPLIFITA. After receiving the goods and having carried out the quality controls, if the non-conformity of the Product is found, BEBE AIRPORT SRL SIMPLIFIED will proceed with the refund using the same means of payment used by the Customer when purchasing the Product.

14 Liability and exemptions

14.1. BEBE AIRPORT SRL SEMPLIFICATA cannot be held responsible for the non-execution of the order on time, or for the non-execution of the Contract of Sale, in the event that the same depended on unforeseeable circumstances or force majeure or any reason in any case not attributable to BEBE AIRPORT SRL SIMPLIFIED.

14.2 In any case, the maximum liability of BEBE AIRPORT SRL SIMPLIFIED for slight negligence, for any loss or damage, pursuant to these Terms of Sale, will be limited to the total price of the Customer's order.

14.3. The aforementioned limitations of liability do not apply in cases of willful misconduct, gross negligence, mandatory liability.

1. Additional important terms

15.1 BEBE AIRPORT SRL SIMPLIFIED may transfer its rights and obligations to third parties, but this will not affect the Customer's rights and obligations.

15.2 Each of the sections and paragraphs of these Terms operates separately. In the event that one or any of them becomes unenforceable, the remaining sections or paragraphs will remain in full force and effect.

16 Applicable law and competent court

16.1. These General Conditions of Sale are governed by Italian law, and the contracts are understood to be finalized in Italy.

16.2 For any controversy arising from the application and/or interpretation of these conditions and from the sales contracts, the Court of Vicenza will have jurisdiction.

17 Intellectual Property

17.1. The trademarks, names, textual and graphic contents, illustrations and images reproduced on the Site cannot be used except in an exclusively private sphere. Any total or partial reproduction of the Site is strictly prohibited, and no right to the contents and brands reproduced on the Site derives from access to the Site or from the purchase of the Products.

18 Treatment of personal data

18.1. For the execution of the contract, the provision by the Customer of some personal data is mandatory. The Customer declares and guarantees that the data provided to BEBE AIRPORT SRL SIMPLIFIED during the purchase and/or registration process are correct and truthful. Failure, partial or incorrect provision of the Customer's data to BEBE AIRPORT SRL SIMPLIFIED may result in the impossibility of executing the contract.

18.2. BEBE AIRPORT SRL SIMPLIFIED guarantees the processing of the Customer's personal data in accordance with and in compliance with Legislative Decree no. 196/2003 (Privacy Code) and subsequent amendments (see Legislative Decree 101/2018), and ensures to adopt specific security measures to prevent the loss of data and/or their illicit and/or unauthorized use. The data provided by the Customer will be recorded by BEBE AIRPORT SRL SIMPLIFIED and used to execute the contract and, subject to his consent, for any further activities, as indicated in the privacy policy provided to the Customer through the Site at the time of his registration.

18.3. For everything concerning the processing of the Customer's personal data, their conservation, their possible modification and/or cancellation, access to them and in general the Privacy policy adopted by BEBE AIRPORT SRL SIMPLIFIED, please refer to the specific EC Regulation, European Parliament 27/04/2016 n° 679, GU 04/05/2016 published on the Site and available through our Privacy Policy.
